What this actually means
As-Is Is About Repairs, Not About Secrets
Selling as-is means the buyer accepts the property in its current condition and you are not agreeing to repair anything before closing. That is the whole of it. It is a statement about who carries the repair burden, not permission to conceal what you know.
This is the part sellers most often get wrong. Texas requires a seller of residential property to give the buyer a written notice about the condition of the property, the seller’s disclosure notice under Property Code §5.008. Selling as-is does not remove that obligation. You still tell the buyer what you actually know about the roof, the foundation, previous flooding, termites and the rest. What changes is that you are not promising to put any of it right.
Handled properly, that combination is genuinely protective. A buyer who has been told in writing about the foundation movement and bought anyway has a much weaker complaint later than one who discovers it afterwards. Sellers who try to sell as-is and stay quiet get the worst of both: no repair obligation, and real exposure.
There is a second, practical meaning. When we say we buy as-is, we mean we are not going to come back after an inspection and ask you to fix things or cut the price. If I sell as-is, do I still have to fill in a seller’s disclosure?
In most residential sales in Texas, yes, selling as-is does not remove the disclosure obligation. There are limited statutory exceptions, including certain sales by an executor or administrator of an estate. If you think an exception might apply to you, confirm it with a Texas real estate attorney rather than assuming.
Can your offer drop after you have seen the house?
