What Texas Actually Requires To Transfer A House
There is no legal requirement to use a real estate agent to sell your own property in Texas, and no requirement to use an attorney at closing either, unlike some states. What a sale does require is a valid written contract, the statutory disclosures, a properly executed deed, and someone to handle the money and the recording. In practice that last part is a title company.
The title company is the piece people underestimate. It searches title, identifies liens and defects, issues a commitment, holds funds in escrow, prepares the closing documents, disburses payoffs, and gets the deed recorded with the county clerk. That is the machinery of the transaction, and it happens with or without an agent involved.
What an agent actually supplies is different: pricing judgement, marketing reach, access to the multiple listing service, negotiation, and management of the option period, appraisal and financing contingencies. If you sell privately you are doing those yourself, and the commission you save is the payment for that work.
Also worth knowing if you have listed before: a listing agreement usually contains a protection period, meaning the agent may still be owed commission if you sell to a buyer they introduced, even after the agreement expires. Read the agreement you signed before assuming a lapsed listing leaves you free.
